After the notice and hearing set forth in Section 6.13.080B, the hearing officer may
further find, in writing with supporting substantial evidence, that an animal is so
vicious, or that other special circumstances exist, such that maintaining the animal
poses a substantial threat to health and safety of human beings, domestic animals,
or livestock. Ten (10) business days after mailing notice of a finding under this
section, the animal control department may dispose of the vicious animal by humanely
destroying it by injection. This section shall not be applicable to appeals to the
superior court.
