§ 17.43.500. Required standards and criteria.
The planning director shall grant a day care permit for a large family day care home as an accessory residential use on property zoned for single-family residences provided that the use complies with all of the following standards and criteria:
A.
The facility is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes;
B.
No major structural changes are proposed which will significantly alter the character of the single-family residence or change its occupancy classification pursuant to the California Uniform Building Code;
C.
Provisions have been made to provide a minimum of one off-street parking space per employee at maximum shift of day care facility operation. The existing residential driveway will suffice as a parking area provided it does not conflict with any required child drop-off/pick-up area, and does not block the public right-of-way or sidewalk;
D.
The operation and conduct of the facility shall comply with the noise standards contained in Chapter 9.18 of this code;
E.
Residences on major arterial streets, as determined by the town engineer and planning director, shall provide a child drop-off/pick-up area designed to prevent vehicles from backing onto the major arterial roadway;
F.
The provider shall comply with all applicable regulations of the state Fire Marshal and/or Paradise fire department regarding health and safety requirements;
G.
The provider shall comply with all applicable regulations of the town sewage disposal ordinance regarding health and safety requirements assigned to a single-family residence;
H.
The provider shall secure a large family day care home license from the State Department of Social Services;
I.
The facility shall not be located adjacent to another approved large family day care home, or shall not create a situation where any single-family residence is bounded on more than one side by a large family day care facility;
J.
A proposed large family day care home that generates public traffic use in addition to the existing level of traffic use of a private road easement affording its access shall not be permitted unless written consent is provided by all property owners having legal interest in the private road easement;
K.
Any proposed large family day care home affording access by use of a private road easement shall be conducted in a manner that shall not overburden the vehicular use of the private road easement.
